Adult entertainment businesses could face big fines:

July 11, 2007 (WAUKEGAN, Ill.)

Two nude dancing clubs and an adult video store in Lake County could face massive fines for violating an adult-entertainment ordinance.

A circuit court judge ordered the closure last month of Dancers in Deer Park, Baby Dolls in Wadsworth and an adult video store on Route 41 for violating the ordinance.

It bans total nudity in adult businesses and also requires them to get licensed by the county.

For violating the ordinance, the businesses could face cumulative fines of hundreds of thousands of dollars. The potential penalty is 500 dollars a day for each day the ordinance was violated.

That means the county could collect a total of more than two (M) million dollars in fees because the violations date back years.

A hearing on the matter is scheduled for August Eighth.

Vote could decide fate of adult entertainment venue:

July 21, 2007

TOWN OF MENASHA — The Town Board Monday holds the swing vote on Winnebago County’s attempt to rewrite its zoning ordinance on adult-entertainment facilities because its current ordinance might be ruled unconstitutional.

“If we vote in favor of the change it will pass, if we vote against it will fail,” said Director of Community Development George Dearborn. The issue comes back to the board Monday after it asked for a 30-day delay last month.

The Winnebago County Corporation Counsel John Bodnar, the town’s Planning Commission and community development staff recommend the revisions that include changing the 2,000-foot setback from residences, schools or parks to 600 feet.

Under the 2,000-foot setback, Dearborn said county officials indicated “there are no places in the county that would allow adult-entertainment.” That position that has led to court decisions against such restrictions because courts have ruled such uses are permissible and cannot be banned completely, he said.

The board delayed its decision in order to get a legal opinion from Town Atty. Chuck Koehler regarding previous court rulings on the setback issue for adult entertainment facilities.

Council considers limiting adult entertainment businesses:

TULLYTOWN - The borough council may adopt an ordinance that would put adult businesses on a short leash if they want to operate in Tullytown.

Council President Beth Pirolli said the ordinance would control and regulate the location and operation of any adult businesses that want to move into the borough. There aren't any in Tullytown now.

The ordinance covers strip clubs and stores mainly selling sex toys and reading material and adult arcades.

“This will prevent an abundance of such adult businesses in the community,” she said Thursday afternoon. “... The spacing regulations will prevent a "red light' type district.”

The borough is taking steps toward strict zoning for adult entertainment businesses as a precaution because other communities are also taking similar measures, leaving the council concerned that the borough will be a haven for those types of businesses, the council said.

Under the ordinance, adult businesses would be permitted as a special exception in light industrial zones only. There's only one section in town that is zoned light industrial, and that's near the border with Bristol Township.

Sunrise Beach prepares adult entertainment ordinance:

SUNRISE BEACH - A 15-section ordinance outlining adult-entertainment businesses will be posted on the doors of village hall today.

The adult entertainment ordinance covers everything from definitions of an exotic dancer, server and manager to the ten-point criteria a business will have to comply with in order to establish such a business within village limits.

City Looks at Adult Entertainment District:

ST. AUGUSTINE, FL -- Just south of the "Welcome to St. Augustine" sign on U.S. 1, city commissioners have proposed the city's fist adult-entertainment district.

Commissioners say it would safeguard adult entertainment businesses from setting up shop anywhere else in the city, including in residential and historic areas.

Monday night, a crowd of business owners and residents packed into the city commission chambers to voice their disapproval.

"After seeing what's happened around us in other cities and counties, and in Jacksonville, we're going to be proactive in trying to eliminate the potential for problems," Commissioner Don Crichlow said.

However, business owners in and near the proposed district oppose it.

They say adult entertainment establishments would chase away customers and change the clientele at their hotels and businesses.

Sherri Meuser is a realtor. She's beginning to have a tough time selling a house that sits on the edge of the district.

"We've had quite a few calls asking about how the house is so close to the district," Meuser said. "They've asked about if the hotels would be x-rated gathering places."

Michael Ghelerter lives near-by and says if commissioners allow adult entertainment businesses by his neighborhood, they would de-value the property and quality of life.

"They claim that they're going to make the rules so difficult so one will bother to apply," Ghelerter said. "Human nature tells me if someone wants to, he'll find a way around their strict rules."

The proposed district is small. It's less than a block wide by a half mile long. Crichlow said the city chose this area because it does not include any permitted churches, schools, or a historic district.

Crichlow said he does not believe the city is "creating anything. We're eliminating the rest of the town and leaving this part of the town exactly the way the rest of the town is now."

Late Monday night, the commission voted to table the matter for another month.

Commissioners, however, did vote on a definition of the word "nudity" and on codes for advertising.

DeSoto County to regulate adult entertainment:

June 29, 2007

DESOTO COUNTY -- A proactive DeSoto County Commission on Tuesday unanimously approved a package of three ordinances aimed at regulating adult entertainment establishments.

There are no such establishments currently in operation in the county, but the county commission, like the city council, decided to enact legislation to be prepared for the possibly there might be applicants for such permits in the future given the economic development of the county.

The U.S. Supreme Court has ruled that adult entertainment establishments -- or sexually oriented businesses -- cannot be prohibited by local governments: they can only regulated.

East Rutherford wants to establish an adult entertainment district:

An adult playground of strip clubs, porn stores, massage parlors and tattoo shops could be coming to an industrial area in the East Rutherford Meadowlands.

The borough hopes to create a special district for X-rated businesses on roughly 10 lots not far from Berry's Creek. It's an effort aimed at keeping sex shops and go-go joints out of residential areas, officials said.

But judging from the surprised reaction of some of the people who work nearby, establishing an adult entertainment zone will be anything but child's play.

Entertainment News Blog Comment: Entertainment for us is nothing more than 'eat, drink, and be merry'; and as far as being merry is concerned, our sight goes only up to sex and violence.

Both sex and violence as entertainment are our reaction against the suppressive ways of life that don't let us enjoy what we do as our daily routine of life.

Adult entertainment not only comprises sex, but more its distortion along with the insult it inflicts on the entertainers resulting in a very subtle form of sexual violence also.
